Terms and Conditions for Purchase of Instructor Training

 

Acceptance:  TOUCHÉ Fitness, TK FIT INC, and its contractors and agents provide their services to you subject to these Terms and Conditions and when you book the training you accept these Terms and Conditions. Please read these Terms and Conditions carefully before booking the training.

 

Instructor Training: In these Terms and Conditions, “Instructor Training” means the training workshop for the specific TOUCHÉ Fitness program.

 

Warranty: You warrant that you are purchasing the Instructor Training for the purpose of conducting TOUCHÉ Fitness classes in accordance with the Instructor Agreement.

 

Initial Training: By accepting these Terms and Conditions you are indicating that you wish us to arrange and provide to you the TOUCHÉ Fitness instructor training based on the information as set out on the TOUCHÉ Fitness website.

 

Certification: You agree that in order for you to be considered for certification, you must first.

• Attend and complete all of the Instructor Training

• Have a TOUCHÉ Fitness instructor account and subscription

• Submit a video of yourself conducing a TOUCHÉ Fitness class within 90 days of the Instructor Training.

TOUCHÉ Fitness will certify you when you have satisfied the video assessment guidelines outlined in the Instructor Resources.

 

Pricing and Payment: You must pay the Price for the Instructor Training as set out in the Order Form, together with any relevant sales tax. TOUCHÉ Fitness reserves the right to change prices on the site. The price for the Instructor Training includes the services of TOUCHÉ Fitness approved trainers, provision of venue at which the Instructor Training is held and provision of all relevant course material for the Instructor Training, but does not include meals, accommodations for attendees or apparel. Payment must be made by one of the methods set out in the Order Form unless we agree in writing to another payment method.

 

Incorrect Pricing and Information: In offering information, products or services including the Instructor Training on the TOUCHÉ Fitness website, TOUCHÉ Fitness attempts to be as accurate as possible. However, TOUCHÉ Fitness does not warrant that information, products and service descriptions or pricing is accurate, complete or error-free. In the event that TOUCHÉ Fitness determines that the Instructor Training is mis-priced, taxes and duties are incorrectly calculated, or the Instructor Training contains an inaccurate description, TOUCHÉ Fitness will notify you of the error before the Instructor Training is provided and you will have an opportunity to cancel or amend your request for Instructor Training within a specified time.

 

Cancellations, changes, or alterations by TOUCHÉ Fitness: TOUCHÉ Fitness will endeavor to hold the Instructor Training on the scheduled date but reserves the right to cancel or postpone any Instructor Training. In the event that TOUCHÉ Fitness determines it is necessary to cancel or postpone an Instructor Training, TOUCHÉ Fitness will notify you of such cancellation or postponement as soon as practicable and will give you an opportunity to cancel (with a full refund of the payment you have made in respect of the Instructor Training) or rebook an alternate Instructor Training. TOUCHÉ Fitness is not otherwise liable for compensation in respect of any travel, accommodation or other expenses you have incurred in reliance on the Instructor Training proceeding on the scheduled date.

 

Cancellations, changes, or alterations by you:  Following confirmation of a purchase of Instructor Training, purchases of Instructor Training can only be cancelled, changed or otherwise altered prior to 10 days before the scheduled date of the Instructor Training purchased. If you cancel prior to this date, TOUCHÉ Fitness will refund you payments in respect of the Instructor Training, less an administration fee of $50 for the Instructor Training purchased. No refund will be made or compensation paid in respect of cancellations, changes or other alterations made after 10 days before the scheduled date of the Instructor Training. If you fail to cancel your ticket prior to the start time of the training, you will be considered a no-show and no refund will be given. To cancel or alter your purchase of Instructor Training, send a written notice by email to TOUCHÉ Fitness at touche.exercise@gmail.com. 

 

Warranties and Liability: TOUCHÉ Fitness warrants that it will endeavor to provide the Instructor Training on the specified date. To the fullest extent possible TOUCHÉ Fitness otherwise disclaims all warranties, express or implied including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. TOUCHÉ Fitness shall not be liable for any loss or damage of any kind whatsoever, arising from the supply of training to you, including consequential loss whether suffered or incurred by you or another person and whether in contract or in tort (including negligence) or otherwise and irrespective of whether such loss or damage arises directly from a breach of these terms and conditions by TOUCHÉ Fitness. In no event will TOUCHÉ Fitness be liable for any amounts greater than the amount you have paid for the Instructor Training ordered. Any claim brought by you in connection with the Instructor Training must be brought within 1 year of the date of purchase of the relevant Instructor Training is confirmed.

 

Waiver:  Failure by TOUCHÉ Fitness to enforce any of these Terms and Conditions shall not be deemed to be a waiver of any of the rights or obligations TOUCHÉ Fitness has under these Terms and Conditions.

 

Entire Agreement: These Terms and Conditions, together with the Instructor Agreement referred to above, contain all the terms, representations, and warranties made between the parties and supersede all prior discussions and agreements covering the subject matter of these Terms and Conditions.
